What does Heath require for a patio cover or pergola?
A building permit on the city's form for patio covers and outdoor amenities, pulled by a contractor registered through Heath's online portal. A cover that shares a wall or roof with the house counts as part of the house, and a freestanding one goes behind the house and has to look like it. Behind the take line, the one roofed structure the land side allows is a gazebo of 144 square feet or less.
The permit and who can pull it
- Heath puts remodels, additions, auxiliary buildings, patio covers and outdoor amenities on one residential application, under the 2021 International Residential Code. The form has a line for the foundation engineer and lists the electrical, plumbing, mechanical and foundation subcontractors by name. City of Heath Application for Residential Remodel, Additions, Auxiliary Buildings, Patio Covers & Outdoor Amenities, rev. 11/1/2022
- The city wants a permit any time a building or its utility systems is built, altered, enlarged or replaced. Its own examples include outdoor kitchens and fireplaces, cabanas and auxiliary buildings. City of Heath, Building & Inspections
- The fee schedule has no line that names a patio cover or pergola. Additions and auxiliary buildings are both charged by the square foot, with a $250 minimum, and we confirm with the city which line a cover files under. City of Heath Master Fee & Rate Schedule 2026-2027, effective October 1, 2026, Section 04, Residential Building Permits
- Working without a permit draws a $500 penalty for each occurrence, and a building reinspection costs $100. City of Heath Master Fee & Rate Schedule 2026-2027, effective October 1, 2026, Section 04
- Contractors register with Heath on the city's OpenGov portal, which is also where permits are applied for and paid and inspections are scheduled. Initial registration is $100. City of Heath, Building & Inspections

Attached or detached, by Heath's definition
The answer decides which rules apply, so Heath writes the test into its zoning code.
- A structure counts as part of the house when it is built into it, shares a significant wall with it, or sits under an extension of its roof, as the Building Official decides. Anything else is detached. City of Heath Code of Ordinances, Chapter 159 Zoning, § 159.42, accessory building
- A detached structure goes in the rear yard, behind the back wall of the house, the side farthest from the street the lot faces. City of Heath Code of Ordinances, Chapter 159 Zoning, § 159.42
- It also has to echo the house: a similar roof pitch, roofing and roof color, and similar wall materials, textures and colors in the same proportions the house uses. City of Heath Code of Ordinances, Chapter 159 Zoning, § 159.42
- Trellises, open gazebos and other decorative structures up to 120 square feet are exempt from the side and rear setbacks, except on a side that faces a street. A patio or deck no more than 30 inches off the ground is exempt too. City of Heath Code of Ordinances, Chapter 159 Zoning, § 159.87(A)
- Where a side or rear yard backs onto the Dallas take line, the Board of Adjustment can grant a special exception to that setback for any structure. City of Heath Code of Ordinances, Chapter 159 Zoning, § 159.87(B)

Past the take line on Lake Ray Hubbard
Heath subleases the Dallas-owned strip between lakefront lots and the water, and its Lake Edge rules decide what may stand there.
- The sublease is $600 for the first year and $350 for each year after. City of Heath Master Fee & Rate Schedule 2026-2027, effective October 1, 2026, Section 03, Take Area & Appeals
- Every structure in the take area needs a Heath building permit, and its plans have to be approved by both Heath and Dallas before work starts. Erosion protection along the leased shoreline is finished first. City of Heath Residential Take Area Sublease Agreement, Art. 3(C), 6(C) and 6(H)
- The sublease bars habitable structures and toilets outright, and propane tanks unless Heath and Dallas approve first. It runs through December 3, 2044, and it can pass only to a new owner of the house. City of Heath Residential Take Area Sublease Agreement, Art. 4(A) and 6(B)
- On the land side, a gazebo is one story on steel-reinforced concrete piers, no bigger than 144 square feet, with its roof no higher than 18 feet without a clerestory and no more than 18 inches of overhang. It sits above elevation 438.0 and 6 feet in from both side lease lines. City of Heath Lake Edge Zoning District Ordinance, October 19, 2006, rev. August 16, 2007, SF-P, landside gazebo, pp. 33 to 34
- Decks and patios out there carry no roof at all. They stop at 400 square feet and 36 inches tall, above elevation 438.0, and even a permanent picnic table stays open to the sky. City of Heath Lake Edge Zoning District Ordinance, October 19, 2006, rev. August 16, 2007, SF-P, pp. 29 and 37
- A barbecue pit takes a Conditional Use Permit. It burns charcoal or wood and never gas, is built from native stone, brick, concrete and iron grating, stands 8 feet tall at most and keeps 12 feet from any picnic table. City of Heath Lake Edge Zoning District Ordinance, October 19, 2006, rev. August 16, 2007, SF-P, p. 28
- Private utilities in the take area run underground, never overhead. Light poles are aluminum or steel, every fixture is shielded to throw light down, and no outdoor light goes below elevation 438.0 except on a catwalk. City of Heath Lake Edge Zoning District Ordinance, October 19, 2006, rev. August 16, 2007, SF-P, pp. 35 to 38

Heath Questions
What people in Heath ask us
Do I need a permit for a patio cover in Heath?
Yes. Heath has one residential application for patio covers and outdoor amenities, and the contractor filing it has to be registered on the city's portal.
Will Heath treat my cover as attached or detached?
Attached if it shares a significant wall with the house or sits under an extension of its roof. Otherwise detached, which means behind the house and built to match it.
Does a freestanding pergola have to match my house?
Heath's code asks detached structures for a similar roof pitch, roofing and color, and similar wall materials and colors. An open pergola has little wall, so we settle with the city how that reads before the design is final.
Can I put a covered patio behind the take line?
Not a patio cover. On the land side the ordinance allows a one-story gazebo up to 144 square feet on concrete piers, above elevation 438.0, after the sublease and with Heath and Dallas approving the plans.
Can I cook down by the lake?
With a barbecue pit on a Conditional Use Permit, burning charcoal or wood. Gas is not allowed for it, and propane tanks need Heath and Dallas approval under the sublease.
How is a Heath patio cover priced?
In writing, after a walk of the yard and a design you have approved. The price moves only if the scope does.
