What the City of Heath requires
Heath regulates fences under Code Chapter 157. It is a detailed ordinance and it is stricter than most of its neighbors. Permit required. Fee $100.00 , from the 2026 Amended Fee Schedule dated 12 May 2026. Lower figures circulate online from older city forms. The adopted schedule governs. Trigger: a new fence, or an alteration or repair exceeding 25 percent of total fence area . Eight feet maximum on or behind the front of the building structure. Front yard, and side or rear yards abutting a street: 4 feet , with a possible exception to 5 feet from the City Manager subject to a 15-foot separation from the right-of-way. Post spec: privacy fence posts must be metal or galvanized steel set in concrete at minimum 18 inches depth, no more than 8 feet apart . Posts face in. Fence posts and rails must face the interior side of the yard and, except the top cap, may not be visible from the public way. In yards with pools, posts and rails face the poolside. In front of the front building line, fences must be ornamental wrought iron or tubular steel with an average 75 percent open area . Chain link, wire fencing, chicken wire, barbed wire and razor wire are not permitted. Sports court fencing may be chain link but must be vinyl coated. If a gate crosses a driveway, it must be offset at least 30 feet from the street pavement edge. Front gates 7 feet maximum, 10 feet on estate lots. No fences in the 100-year floodplain except as approved by the City Engineer. Where provisions conflict, the most restrictive applies. Heath’s fee schedule has no deck or patio line item at all , so we confirm that with the city rather than guessing. Read from the city’s own published code and adopted fee schedule on 22 August 2026. Codes and fees change and city staff interpret them, so we confirm for your address before we pull the permit. If you are on the water
Heath protects the lake view by ordinance
Fences on lakefront properties must be ornamental wrought iron or tubular steel with at least 75 percent open area per linear foot , specifically to maintain surrounding lake views. Fences are prohibited in the take line area except as allowed under the Lake Edge Zoning Ordinance. There is one exception worth knowing. Lakefront lots more than 35 feet from the rear property line , with the fence built entirely behind the main residential structure, may use privacy fencing. If you are on the water in Heath and you want privacy, that 35-foot rule is the whole conversation. We measure it before we design anything, because it decides whether the fence you have in mind is even legal. Key lots are also caught by this: front yard rules for height, location and materials apply regardless of where the fence sits, and key lot fences need at least 75 percent open area per linear foot. The most active soil of any county we work in
Heath is in Rockwall County, which has the highest shrink-swell exposure in our service area. 94 percent of mapped land in this county is rated high or very high for movement across the top three feet, and the county is 39.5 percent Houston Black clay. Houston Black moves about 13 percent of its length between wet and dry. The USDA documents cracks half an inch to four inches wide at twelve inches deep, staying open 90 to 150 cumulative days in most years. Heath’s own 18-inch minimum post depth is the city acknowledging that. We generally go deeper. The code is a floor, not a target, and on ground that opens and closes like this the difference between the minimum and a properly sized footing is the difference between year three and year ten. Soil figures computed from USDA-NRCS SSURGO county data. These are county-level figures, not parcel-level. A specific address needs its own lookup, which we do before quoting a long run.
