What the City of Murphy requires
Murphy regulates fences under Section 26.03.003 of its code of ordinances, and it is one of the few cities around here that writes post depth into the law.
- A permit is required for every fence.
- Repairs need one too once you replace 15 linear feet or more, or five or more posts, and a repair has to use comparable materials in a comparable color.
- The residential fence permit is $100.00 under the Appendix A fee schedule, and the fee doubles if work starts without one.
- When the fence is finished it is inspected before the city accepts it.
- Contractors register with the city, $100.00 a year for a general contractor.
- Post depth by fence height: three feet for a fence eight feet or taller, two feet for a six foot fence, and 18 inches for four feet or lower.
- Eight feet maximum on residential property, measured from the applicant’s side.
- No fence in the required front yard at all unless the lot is an acre and a half or larger, and there it is four feet and at least 50 percent open.
- Where a privacy fence faces a street, the posts go on the inside.
- Not allowed: barbed or razor wire, chicken wire, hog wire and similar welded or woven wire (chain link is fine), used materials, electric fences, galvanized sheet metal, corrugated metal or fiberglass, and anything not rated for outdoor exposure.
- If the fence is wood, every wood element, posts included, must be pressure treated with ACQ, copper azole or MCQ, or be untreated cedar or redwood.
- Two fences may not run back to back closer than five feet apart.
- Fences have to stand up to a 70 mile per hour wind and may not lean more than 20 degrees, and masonry columns over four feet need an engineer’s stamped design.
- Easements are where the expensive surprises are: no fence goes in any easement without prior written approval from the agencies that hold it, and inside a utility, surface drainage or maintenance easement the fence has to be ornamental iron with removable sections, its bars three to 3-15/16 inches on center and two inches clear of grade.
- Nothing may be attached to a subdivision’s masonry screening wall.

Decks, arbors and patio covers
Murphy builds to the 2021 International Residential Code, in force since 1 March 2024, with local amendments that strip out most of the model code’s permit exemptions.
- Decks are on the city’s list of projects that need a permit, and the amendments drop the small-deck exemption, so in Murphy every deck is permitted work.
- The deck permit is $100.00, and the plan has to show the deck’s dimensions, height, stairs and means of support, its materials, and the size and spacing of every post, joist and girder.
- Arbors, gazebos, patio covers and pergolas need a permit too, $100.00 under the fee schedule’s arbor and patio cover line.
- A freestanding arbor, gazebo or pergola stays at least five feet from the side and rear lot lines, and no accessory building goes in a dedicated easement.
- Attach one to the house and it has to meet the house’s own setbacks instead, which in the SF-11 district, for example, means a 20 foot rear yard.
- Lot coverage counts both: SF-11 caps the house and accessory buildings together at 35 percent of the lot.
- For an arbor, pergola or gazebo the city asks for two site plans, a foundation or pier plan, a roof framing plan, elevations and a typical cross section.
- Accessory buildings run in three tiers: up to 120 square feet, five feet off the side and rear lines and 12 feet tall at most; up to 500 square feet, five feet and 16 feet; over 500, ten feet and 24 feet.
- In Windy Hill Farms phases 2, 3, 4 and 6 and in Rolling Ridge Estates, an accessory building also needs a brick or stone exterior of at least 75 percent.
- Retaining walls must be stone, brick or other masonry, and anything over four feet has to be designed and sealed by a Texas registered engineer.
- The HOA is a separate approval again: Murphy’s code says a fence permit does not constitute or supersede it, and the city tells every applicant to check deed restrictions and covenants before building.
Two thirds of Murphy is Houston Black
Murphy sits in southeastern Collin County, and clipped to its city limits the USDA soil survey puts about 68 percent of the city on Houston Black clay, the Texas state soil, with Heiden clay adding another 13 percent.
- Of the ground the survey rates, 88 percent is high or very high for shrink-swell across the top three feet, and 84 percent sits in the very high band.
- That is higher than Collin County as a whole, which comes out at 74 percent on the same method, and higher than Plano next door at 68.
- The USDA describes Houston Black as very deep and very slowly permeable, and when it dries it opens cracks half an inch to four inches wide that reach 12 inches deep or more and stay open 90 to 150 cumulative days in most years.
- Murphy’s code sets post depth by fence height, two feet for a six foot fence, and on ground this active we treat that as the floor it is rather than the target.
