What the City of McKinney requires

McKinney's fence rules are in Article 7 of its Unified Development Code, Chapter 150 of the city code.

  • A permit is required before building a fence or making any alteration, addition or change to one.
  • The city's fence permit page puts it as three questions: will the height, the location or the material change?
  • Answer yes to any of them and you need a permit.
  • Answer no to all three and the work is a repair.
  • The permit fee is $30, and the application is a site plan, a survey or a hand drawing, showing the property lines and the fence's location, height and material.
  • Four feet maximum in the front yard, and at least 50 percent open for the full height.
  • Eight feet six inches in the side and rear yards behind the front building line.
  • Where a rear or side yard runs alongside a neighbor's front yard, the limit there is four feet and 50 percent open, or six feet in wrought iron if the building official sees no sight distance problem.
  • A fence next to a required screening wall is built at the wall's height.
  • Inside the historic overlay the side and rear limit is six feet eight inches, and a Certificate of Appropriateness comes before the fence permit.
  • Chain link under five feet in a residential district puts its finished edge on top.
  • Barbed wire is limited to industrial districts and public property, electric fences to the agricultural district, and a masonry wall over four feet needs an engineer's sealed design.
  • Every fence enclosure needs at least one gate.
  • No fence inside the triangle 20 feet back from two streets meeting, or 15 feet back where a street meets an alley.
  • No fence in a drainage easement unless the city decides it will not impair the flow of water.
  • No part of a private fence, braces included, on or over city property.
  • A fence around a pool or spa follows the pool barrier rules and is inspected.
  • Since 5 October 2026 a permit can also issue for a platted lot with no house yet, if the fence is at least 50 percent transparent.

Source: Read from the Unified Development Code as attached to the city's February 2026 council packet, the ordinance amending its fence permit section approved on 5 October 2026, and the city's fence permit page, on 11 October 2026. Codes and fees change and city staff interpret them, so we confirm for your address before we pull the permit.

Pergolas, patio covers and decks

The development code names gazebos, pergolas, arbors, decks and shade structures as accessory structures.

  • Attach one to the house and it is treated as part of the house, with the house's setbacks.
  • Detached, it tops out at 12 feet tall and sits behind the front face of the house, never in the front yard and never in an easement.
  • How far it stays off the side and rear lot lines depends on its size. One foot at 100 square feet or less. Three feet from 101 to 300. Five feet from 301 to 500.
  • Past 500 square feet it takes the zoning district's own setbacks.
  • The city's permit page files detached patio covers and shade arbors under residential alterations and detached accessory buildings, applied for through its online portal.
  • McKinney adopted the 2024 International Residential Code with the regional amendments on 1 October 2025.
  • Its own change to the model code's permit exemptions touches only the shed line, cutting it from 200 square feet to 120.
  • The small deck exemption stays as the model code writes it: a deck of 200 square feet or less, no more than 30 inches above grade, not attached to the house and not serving the required exit door needs no building permit.
  • It still has to meet the accessory setbacks above.
  • In the historic overlay a fence also needs a Certificate of Appropriateness, so we check whether a lot is inside it before anything else.

The ground under a McKinney fence

McKinney sits entirely in the Collin County soil survey. Clipped to the city limits, about 40 percent of the city is Houston Black clay and 22 percent Austin silty clay, with Altoga at 8 and Tinn at 7.

  • Of the ground the survey rates, 60 percent is high or very high for shrink-swell across the top three feet, and 53 percent is very high.
  • That is well below Collin County's 74 percent.
  • Much of McKinney sits on Austin, which formed over chalk, and on Altoga, a very deep, moderately permeable soil on the sloping edges of old stream terraces. Tinn is the one to watch along the creeks.
  • It is a very deep flood plain clay, and when it dries it cracks half an inch to two inches wide and more than a foot deep, for 60 to 90 days in most years.
  • The development code sets no post depth for a residential fence, so we size it for the ground the fence actually crosses.

Neighborhoods we serve in McKinney

From Stonebridge Ranch and Craig Ranch to Tucker Hill and the historic district, we build fences, decks and patio covers across McKinney, all of it in Collin County. The historic district runs on its own fence heights and needs a Certificate of Appropriateness before a fence permit, so we check which side of that line you are on first. Your HOA's rules sit on top of the city's, and we ask about both.

McKinney Questions

Home project questions in McKinney

Do I need a permit to replace my fence in McKinney?

Only if the height, the location or the material changes. If all three stay the same, the city treats the work as a repair. When a permit is needed, the fee is $30.

How tall can a fence be in McKinney?

Eight feet six inches in the side and rear yards behind the front building line, and four feet in the front yard, where it has to be at least 50 percent open. The historic overlay caps side and rear fences at six feet eight inches.

How close to my back fence can a pergola go in McKinney?

It depends on its size: one foot for 100 square feet or less, three feet up to 300, five feet up to 500, and the zoning district's setbacks beyond that. A detached pergola can be no taller than 12 feet.

Does a small deck need a permit in McKinney?

Not a building permit, if it is 200 square feet or less, no more than 30 inches above grade, freestanding and not serving the exit door. McKinney left that exemption alone in its 2025 code update. The deck still has to meet the accessory setbacks.

I live in McKinney's historic district. Is anything different?

If your lot is in the historic overlay, yes. A fence needs a Certificate of Appropriateness before the permit, and side and rear fences stop at six feet eight inches unless the Board of Adjustment grants more.

Can I fence a lot before the house is built?

Since 5 October 2026, yes on a platted lot, if the fence is at least 50 percent transparent. Otherwise the city issues a fence permit only once there is a house or a permit to build one.
