What the City of Allen requires

Allen puts its fence heights in Section 7.07 of the Allen Land Development Code and the build details in a residential fence guideline the city revised in June 2026.

  • Allen's amended residential code drops fences from the list of work that needs no permit, and the fee schedule prices a fence permit at $75.00.
  • Contractors register with the city every year, $50.00, before a permit issues.
  • Eight feet maximum in back and side yards, measured from the adjacent grade.
  • On top of a retaining wall the fence is still eight feet, and wall and fence together stop at twelve. The front yard is closed to fences.
  • The only exception is a fence under 36 inches built as part of an unenclosed front porch or an uncovered patio.
  • Approved materials are brick, wood and wrought iron, and anything else needs the building official's approval.
  • Every fence needs metal posts set 18 inches deep in concrete, with metal caps and hardware. No fence of any kind in a floodplain.
  • An easement needs written permission from the Engineering Department, with one exception.
  • The standard three foot drainage easement along a lot line can be fenced if the bottom of the fence sits at least three inches above grade.
  • Every part of the fence stays on your side of the property line.
  • A lot backing onto a greenbelt, open space or park needs an ornamental metal fence at least six feet tall on that side, unless the planning commission approves something else.
  • A sliding gate across a rear entry driveway has to follow one of the city's two trash pickup layouts.

Patio covers, decks and pools

Allen builds to the 2021 International Residential Code with its own rewrite of the permit exemptions.

  • A deck under 200 square feet and no more than 30 inches above grade at any point needs no permit.
  • Allen's version leaves out the model code's conditions about attaching to the house and serving the exit door.
  • The shed exemption covers storage sheds, playhouses and similar uses up to 120 square feet or eight feet tall.
  • A patio cover has its own fee line: $200.00 for an arbor, patio or carport.
  • An accessory structure is $75.00 from 120 to 200 square feet and $125.00 from 201 to 400.
  • The city's patio cover guideline, revised June 2026, sets the layout.
  • An attached cover stays inside the house's build lines.
  • A detached cover sits three feet from the side and rear lines where there is an alley, and five feet from the rear line where there is not.
  • At 400 square feet or more it follows the build lines.
  • Nothing goes in the three foot public drainage easement or any other easement, and the fence guideline keeps decks, patio covers and pool decks three feet off the lot lines for drainage.
  • A detached structure also has to sit in the rear yard, or in a side yard at least 20 feet behind the front of the house, and can never be taller than the house.
  • Covers are designed for a 115 mile per hour wind.
  • Metal construction needs an engineer's stamp, and no cover may be carried on brick veneer.
  • For a wood cover, the city's sample sheet asks for footings at least twice as wide as the post, 12 inches into undisturbed soil, with anchor bolts at least half an inch by seven inches.
  • Pools are the one place the documents disagree.
  • The fence guideline says a pool fence is at least four feet tall.
  • Section 4.10 of the code says six, with self-closing, self-latching gates.
  • We build to the code text and confirm with the city.

The ground under an Allen fence

Allen sits entirely in the Collin County soil survey. Clipped to the city limits, about 51 percent of the city is Houston Black clay and 25 percent is Austin silty clay.

  • Of the ground the survey rates, 63 percent is high or very high for shrink-swell across the top three feet, and 59 percent is very high.
  • That is below Collin County as a whole at 74 percent, and the Austin is why. Austin formed in chalk.
  • The USDA's typical profile puts the chalk 29 to 30 inches down, close to where a footing wants to go.
  • Houston Black is the opposite case: very deep, very slowly permeable, and split by cracks up to four inches wide in a dry spell.
  • So one fence line in Allen can cross two very different kinds of ground.
  • Allen's 18 inch post depth is the floor the city sets.
  • On the clay we generally go deeper, and where the auger meets chalk we design the footing for it instead of stopping short.

Allen Questions

Home project questions in Allen

Can I put a fence in my front yard in Allen?

Not as a standalone fence. The only front yard fence Allen's code allows is one under 36 inches, built as part of an unenclosed front porch or an uncovered patio.

What posts does Allen require?

Metal, set 18 inches deep in concrete, with metal caps and hardware. The city's residential fence guideline applies that to all fencing, wood fences included.

Does a small deck need a permit in Allen?

Not if it is under 200 square feet and no more than 30 inches above grade at any point. Read literally, Allen's wording exempts a low deck that size even when it is attached to the house. We confirm with the city before treating any deck as exempt.

Can a patio cover attach to my brick in Allen?

It can attach to the house, but not hang on the brick veneer. Allen's patio cover guideline says a cover cannot be supported by masonry veneer, so we work out the connection before you see a price.

How tall does a pool fence have to be in Allen?

Section 4.10 of the code says six feet, with self-closing, self-latching gates and the latch at least four and a half feet up on the pool side. The city's fence guideline says four feet. We build to the code and check with the city.

My lot backs onto a greenbelt. Does that change the fence?

Yes. Allen requires an ornamental metal fence at least six feet tall on the side facing a greenbelt, open space or park, unless the planning commission approves an alternative.
