Yes, in every city in this guide: a patio cover, and in most of them a pergola too, is treated as an accessory structure that needs a building permit before construction starts. What differs is what the city wants to see (a site plan, a pier plan, sometimes a plan sealed by a Texas engineer), what it charges, and where on the lot the structure may sit. HOA approval is a separate step, and it usually comes first.

Fees and rules change, and city staff interpret them, so treat this as where to start, not as the final word. We confirm the rule and the fee for your address before we file, and we file it ourselves.

Why is a roofed structure treated differently from a pergola?

A roof is a load path. Wind pushes on it and lifts it, rain and the occasional ice load sit on it, and all of that goes down through the posts into the ground. A reviewer wants to see where that load goes, which is why cities ask for pier depths, post bases and framing details, and why some ask for a plan sealed by a Texas engineer. Rowlett's regulations, for example, require accessory buildings to resist a 115 mph wind load and set a prescriptive pier and post-base detail for patio covers, with a sealed plan as the alternative. An open-top pergola carries less, but most cities still permit it as an accessory structure.

How close to the fence can you build?

It depends on the city and the zoning, and easements often matter more than setbacks. Royse City keeps accessory structures, attached or not, five feet from the side and rear lot lines and out of any dedicated easement, which on a lot with a utility easement across the back is often the real limit. Rowlett requires at least three feet from a side property line for an accessory structure in the rear yard, and none on an easement or over an underground gas line. Rockwall's lakefront lots inside the Take Line Overlay have their own height and size caps. Bring your plat or survey to the walk; it shows the easements that decide where a cover can go.

Does the HOA come before the city?

Usually, and the two are separate approvals: getting one does not cover the other. Many newer neighborhoods in Rockwall, Royse City, Fate, Heath and Forney run architectural review on roof material, color, height and placement, and Forney's own submittal list asks for HOA approval where it applies. Submit to the HOA early, because its turnaround can be longer than the city's.

What happens to an unpermitted cover when you sell?

It can surface in the buyer's inspection or the city's records, and the fix is rarely cheap: permitting after the fact usually means exposing footings and connections so the city can see what it is approving, or taking the structure down. Building it permitted the first time is the cheaper path.

How the design, engineering and permit phase handles it

Do I need a permit for a pergola in Rockwall?

Plan on it. Rockwall permits accessory structures, and its fee schedule lists $100 for patio covers, decks and carports. Lakefront lots behind the Take Line have their own limits. We confirm the requirement for your address before we build.

Does a freestanding patio cover need engineering?

Often. Some cities accept a prescriptive pier and post-base detail for a simple cover and others ask for a plan sealed by a Texas engineer; a larger or attached cover is more likely to need the sealed plan. Our patio covers are engineered as part of the design phase either way.
