What does a fence in Fate have to meet?
Metal posts on every residential fence, eight feet at most, at least five feet behind the front of the house, and a permit for any new fence or for replacing a quarter of one inside 18 months. On a corner lot, by an alley or around a pool, the setbacks and heights change again.
Built in Fate
The Fate fence, built to the post rule
About 57 feet of board-on-board cedar with one gate. We tore out the old fence and hauled it off, set powder-coated steel posts in concrete with their attachment hardware, and finished it with one coat of Ready Seal in Dark Walnut.
Steel posts are not optional here. Fate's code requires metal posts on every residential fence, and its permit application asks which kind you are using. On a run that short, the steel posts are a real share of the work.
Scope as contracted: About 57 ft of board-on-board cedar with a gate. Old fence torn out and hauled off, powder-coated steel posts in concrete, stained dark walnut.

When Fate wants a permit, and what goes in it
- A new fence needs a permit, and so does replacing 25 percent or more of a fence’s length within 18 months. The fee is $75. City of Fate Unified Development Ordinance, Chapter 36, Article IX, Sec. 36-9.3, 9.3.3(1)
- The city's older When is a Permit Required handout lists any fence repair or replacement, with no threshold. The ordinance controls, but we ask before treating a repair as exempt. City of Fate, When is a Permit Required
- The application is a Miscellaneous Permit Application plus three letter-size site plans showing property lines, structures, every gate, any easements, materials, the anchoring method and any pool. The form asks outright whether the posts are metal or wood. No survey and no HOA letter are required by the city. City of Fate Submittal Requirements for Common Permits
- Applications, documents and inspection requests go through the MyGov permit portal. A permit nobody has started on expires after 180 days, and work started without one costs twice the fee. City of Fate permit FAQ
- Anyone building for pay inside Fate has to register with the city, carry at least half a million dollars of commercial general liability, and pay $75 a year. A homeowner doing their own homestead is exempt. City of Fate Code of Ordinances, Chapter 6, Secs. 6-1 to 6-3, Secs. 6-1 to 6-3

Where it can go on your lot
- Every fence sits at least 5 feet behind the front face of the house, unless the zoning district says otherwise. City of Fate Unified Development Ordinance, Chapter 36, Article IX, Sec. 36-9.3, 9.3.3(9)
- A second fence within 5 feet of an existing one, running alongside it on a shared line or an easement line, is prohibited. You replace the old fence; you do not build next to it. City of Fate Unified Development Ordinance, Chapter 36, Article IX, Sec. 36-9.3, 9.3.3(7)(b) and (e)
- Fences stay at least a foot back from the right-of-way and from common open space. City of Fate Unified Development Ordinance, Chapter 36, Article IX, Sec. 36-9.3, 9.3.3(7)(c)
- On a corner lot, a fence taller than 2 feet stays 5 feet off the street-side property line. On a reverse corner lot it steps back to the neighboring lot's build-to line. City of Fate Unified Development Ordinance, Chapter 36, Article IX, Sec. 36-9.3, 9.3.3(7)(d)
- At an intersection, nothing taller than 2 feet goes in the sight triangle, which runs 10 feet along the right-of-way and 40 feet back from the corner. Inside an alley right-of-way the limit is 24 inches, and on a mews street a fence stays 7 feet from the back of the pavement. City of Fate Design Criteria and Construction Standards, July 2025, Part I, Sec. 7 item 6(b) and (c); Sec. 9
- The horizontal rails behind the pickets have to be chemically treated lumber at least 2 by 4. City of Fate Unified Development Ordinance, Chapter 36, Article IX, Sec. 36-9.3, 9.3.3(5)(e)

Pools, easements and the wall behind the fence
- A fence that serves as a pool barrier is at least 48 inches tall on the outside, with no more than 2 inches of gap at the bottom over grass or gravel and no opening a 4-inch ball can pass. Gates swing out, away from the pool, and close and latch on their own. City of Fate Barrier Requirements
- If the gate release is under 54 inches high, it goes on the pool side at least 3 inches below the top, with no opening over half an inch within 18 inches of it. While a pool is being built, a temporary fence of at least 36 inches surrounds the work, and the permanent fence and gates have to be finished before the pre-plaster inspection. City of Fate Swimming Pool and Spa Permit Requirements
- Fate's plats carry their own dedication notes, and many say no building, fence, tree or shrub in a dedicated easement. It varies plat to plat, so we read the recorded plat for your lot before setting a post line. City of Fate recorded plat, dedication notes (example)
- A retaining wall under a fence needs its own permit, an engineer's design once it is over 24 inches, and may not be built of wood. An older city handout says permits start at 4 feet; the 2025 design criteria are the current standard. City of Fate Design Criteria and Construction Standards, July 2025

If you live in Woodcreek
Woodcreek is the one Fate community whose fence rules are posted publicly. Most of the others keep theirs behind a resident login.
- Replacing a fence needs an architectural request first. The governing documents give the committee 30 days, and it typically answers in 7 to 10. Woodcreek Fate HOA Welcome Packet, 2024
- A shared fence is a party structure, with the cost split evenly. A new one needs a signed letter from the neighbor agreeing on height, materials, location and stain color. Woodcreek Fate HOA Welcome Packet, 2024
- Six to eight feet above slab grade, stained on both sides in a brown palette or clear, posts on the inside wherever the street can see them, and at least 5 feet behind the front of the house. Wrought iron is allowed where the fence is not shared. Woodcreek Fate ACC request form
- The HOA maintains the perimeter and CD Boren Parkway brick screening walls. Where two lots step down, the owner of the higher lot maintains the retaining wall between them. Woodcreek Fate HOA Welcome Packet, 2024, Supplemental Declaration, Art. III, Sec. 11

Fate Questions
What people in Fate ask us
Do I need a permit to replace part of my fence in Fate?
If you are replacing a quarter or more of its length within 18 months, yes. Below that the ordinance does not require one, though an older city handout says otherwise, so we check first.
How far back from the street does my fence have to be?
At least 5 feet behind the front of the house. On a corner lot, 5 feet off the street-side property line once it is taller than 2 feet.
Can I build a new fence right next to my old one?
No. Fate prohibits a parallel fence within 5 feet of an existing one. The old fence comes out.
Does my pool fence need anything special?
Forty-eight inches on the outside, gaps a 4-inch ball cannot pass, and gates that swing away from the pool and close and latch themselves. It has to be finished before the pre-plaster inspection.
I'm in Woodcreek. What does the HOA want?
An architectural request before you replace it, a signed neighbor letter for a shared fence, six to eight feet, stained both sides in a brown or clear finish, posts facing in where the street can see them.
Is the fence behind my house mine or the HOA's?
If it is a screening wall along a parkway or the community edge, it is likely the HOA's. In Woodcreek the HOA maintains the perimeter and CD Boren Parkway walls.
