What the county requires

For a fence: nothing. Fences are not mentioned anywhere in Kaufman County’s published regulations. The county cannot require prior approval for residential construction. Kaufman operates under Texas Local Government Code Chapter 233, and its own regulations state the residential building notice is not a permit and does not require prior approval before construction begins. The county may not charge a fee for it. The Fire Marshal handles building permits , and that scope is commercial establishments, public buildings and larger multi-family. Single-family residential sits outside it. What the county does permit: floodplain development, on-site sewage facilities, manufactured home and RV parks, culverts and driveways, regulated land use, and 911 addressing. One caveat we flag rather than guess at. A Floodplain Development Permit is required for all development activities within Areas of Special Flood Hazard. We could not locate the county’s definition of development to determine whether a fence or deck triggers one. If your lot is in a mapped floodplain we call Development Services before quoting. Cities inside Kaufman County we work in

Two cities here publish fence ordinances, and they could hardly be more different from each other. City Fence permit Forney: the post spec is in the ordinance: 2 3/8 in. galvanized steel posts, max 8 ft on center, in 3 ft concrete footings for fences over 52 in. Posts face in. 8 ft max $20 or $25 Terrell: every new single-family home must have a rear yard fence before it gets a certificate of occupancy. Repairs need a permit but cost nothing New: not published Poetry: incorporated as a town in 2020 with its own planning and zoning. Most reference material still calls it unincorporated See town Forney is the one genuinely unresolved fee in our whole area: both $20.00 and $25.00 are live in the same current schedule, Ordinance 25-24 of October 2025. Terrell publishes no fee for a brand-new fence at all. We call both cities rather than guessing, and the real figure goes on your estimate. The jurisdiction problem, and the soil under it

A 75126 mailing address does not mean you are in Forney. That ZIP covers a large area including Heartland and Travis Ranch, which are unincorporated Census-designated places, plus parts of Talty, Mesquite, Heath and Dallas. Forney also has roughly 26 square miles of ETJ on top of 14.35 square miles of city limits. So for the same mailing address you might be facing Forney city rules, no fence permit at all, or a different town’s ordinance entirely. If someone quotes you a permit cost for a Kaufman County address without asking exactly where you are, that is a sign. On the ground itself: Kaufman County is only 9.4 percent Houston Black clay. The dominant soils are Crockett, Wilson and Mabank, which are claypan: fine sandy loam for the first seven to nine inches, then clay running 40 to 46 percent clay content. Trinity is also common here and is the exception. It is a bottomland clay with no sandy lid at all, and it measures 13.38 percent linear extensibility, slightly more than Houston Black. Measured over the full three feet a post occupies, that ground moves around 6 to 7 percent against Rockwall County’s 13. Less, not more. But the USDA calls anything above 6 percent high and expects structural damage there, and Kaufman County comes out at 73 percent high or very high across the post zone , with 44 percent in the high band and 29 percent in the very high band. The digging in Kaufman County is easier than in Rockwall. The engineering requirement is not. Forney’s three-foot concrete footing rule on galvanized steel posts is the local authority’s own answer to that. Soil figures computed from USDA-NRCS SSURGO county data. Do I need a permit for a fence in unincorporated Kaufman County?

No. Fences are not mentioned in county regulations at all. Your HOA or deed restrictions may still apply.

I have a Forney address. Do I need a Forney permit?

Not necessarily. A 75126 address can be in Forney city limits, Forney’s ETJ, Talty, Heath, Mesquite, Dallas, or unincorporated county including Heartland and Travis Ranch. We check first.

Is the soil better here than in Rockwall?

It digs easier. It does not hold a post better. Seventy-three percent of this county is rated high or very high for soil movement in the top three feet, and the sandy surface is only seven to nine inches deep.

Does the county inspect my deck?

No. Kaufman County’s building permit scope is commercial, public and larger multi-family buildings. Single-family residential is outside it.
